1. SCOPE
1.1 This Policy explains how PsyMetric Sdn. Bhd. [Registration No. 202101030158 (1430458-M)] uses cookies on the platform at www.psymetric.com.my, its portals and its mobile applications.
1.2 In this Policy “cookies” includes browser local and session storage, and device identifiers used in our applications for the same purposes.
1.3 Where cookies or similar technologies collect or process information that constitutes personal data, such processing is also governed by the Personal Data Protection Act 2010, as amended from time to time, and applicable guidelines and requirements issued by the Personal Data Protection Commissioner, and by our Personal Data Protection Notice. Malaysia does not currently have cookie-specific legislation governing the use of cookies as such; however, the PDPA may apply where cookies or similar technologies involve the processing of personal data.
1.4 Words defined in the Terms and Conditions have the same meaning in this Policy.
2.1 We use cookies to:
(a) keep you signed in, and support two-factor authentication for Practitioners;
(b) preserve your answers and your place while you are completing an assessment;
(c) remember the portal language you chose, and the reading direction where it runs right to left;
(d) show the devices signed in to your account under Active Sessions;
(e) balance traffic across our servers and guard against fraud and automated abuse;
(f) count page views and errors in aggregate so that we can improve the service.
2.2 We do not use advertising or cross-site tracking cookies. We do not sell usage data or share it with advertising networks.
2.3 No cookie stores the content of your Assessment answers, your scores or any clinical note. Such information is maintained in your account record and is subject to our Personal Data Protection Notice.
3.1 Strictly necessary cookies handle authentication, session management, two-factor sign-in, assessment progress, load balancing, security and the Active Sessions list. They are essential for the operation of the Platform and cannot be refused without preventing the Platform from delivering an Assessment. Where such cookies process personal data, the Company relies on the applicable legal basis under the Personal Data Protection Act 2010, including, where applicable, processing necessary for the performance of the Service requested by you. Accordingly, these cookies are not presented as an optional category through the cookie preference mechanism.
3.2 Preference cookies remember your portal language, reading direction and display settings. You may refuse them; your language choice will then not survive between visits.
3.3 Analytics cookies count page views, navigation paths and error rates. They are reported as totals and are not used to build a profile of any individual. They are used only for aggregate service-performance and usage analysis and are not used by the Company to create advertising profiles or behavioural profiles of individual users. You may refuse them by adjusting your preference on the cookie banner displayed when you first visit the Platform, or by changing your browser settings as described in Clause 7.2 below. Refusing analytics cookies will not affect the core functionality of the Service.
4.1 The cookies in use at the date of this Policy are listed below. The current list of cookies used on the Platform is available at [www.psymetric.com.my/cookies-list]. Names and durations change as the Platform develops.
4.2 The cookies names, purposes, categories and durations stated in Clause 4.1 should be read together with the current cookie list published on the Platform. If a cookie is added, removed or materially changed, the current cookie list will be updated accordingly.
5.1 When you make a payment, you are redirected to our payment provider, KiplePay Sdn. Bhd., which sets its own cookies to process the transaction and detect fraud. Those cookies are controlled by KiplePay under its own policies. We do not read those cookies and we do not store your card or bank details on the Platform. 5.2 A site you reach by a link from ours sets its own cookies once you arrive. We do not control them.
6.1 Session cookies last only while your browser is open. Persistent cookies last for the period shown in clause 4.1 or until you delete them. Signing out, or using Sign Out of All Devices, ends the session cookies for your account.
7.1 Where a cookie banner is shown you may accept or refuse the preference and analytics categories and change that choice later. Strictly necessary cookies are not offered as a choice.
7.2 Every major browser lets you see, delete and block cookies, usually under Settings and then Privacy. Deleting cookies signs you out and clears your saved language.
7.3 If you block strictly necessary cookies you may not be able to log in or take an Assessment. If you block them part-way through an Assessment, your answers may be lost. Any refund consequences are governed by Clause 7 of the Terms and Conditions.
7.4 Browsers implement Do Not Track inconsistently, and there is currently no universally accepted technical standard for responding to such signals. Accordingly, we do not currently respond to Do Not Track signals. To control cookies on the Platform, please use the cookie banner described in Clause 7.1 or the browser settings described in clause 7.2. We will review our position on Do Not Track as industry standards develop.
8.1 We may update this Policy when the cookies we use change or when the law changes. The current version and its date are published on the Platform. Where an amendment materially affects the contractual rights or obligations relating to the Service, the applicable amendment provisions in Clause 18.6 of the Terms and Conditions shall apply. In the event that a Bahasa Malaysia version of this Policy is also available and any inconsistency arises, the English version shall prevail to the extent permitted by law.
